Legal win for Tucson neighborhood over Navajo Wash homeless camps | Local News



TUCSON, Ariz. (KVOA) – The Hedrick Acres Neighborhood Association (HANA) has won an appeal against the City of Tucson regarding homeless camps in Navajo Wash.

The Appeals Court found the City liable for the public nuisance caused by the camps.

The court’s decision mandates the City to ban homeless camps in Navajo Wash, aligning with existing bans near schools and most city parks.

The ruling challenges the legality of Tucson’s 3-Tiered Homeless Protocol, highlighting that Tier 2 camps—comprising 80% of all camps—are often public nuisances.

The City is now responsible for addressing the issues these camps create.

This case follows a similar lawsuit by Armory Park against the Episcopal Church, prompting other neighborhoods to consider legal action against entities allowing homeless camps.
