Judge raises bond for California farming mogul amid premeditated murder charge in eastern Arizona

PHOENIX — A Navajo County judge slightly increased the bond and imposed strict release conditions Wednesday during the first appearance hearing for Michael Abatti, a Southern California farmer charged with murdering his estranged wife, Kerri Abatti, in Arizona. Abatti pleaded not guilty to a charge of first-degree murder.

Abatti faces a first-degree murder charge stemming from the November alleged killing of his wife at her home in Pinetop, according to investigators. Prosecutors allege Abatti drove more than six hours from California to Arizona, shot his wife through a kitchen window from outside the home, then returned to California, an act they say demonstrates clear premeditation.

Victim statements, submitted under seal, argued that a previously set $5 million secured appearance bond was insufficient to ensure safety.

“What’s unique is sometimes in homicide cases, you have the victim representatives, and you may have the defendant who has a brief interaction with a victim’s family,” the prosecutor told the court. “These are his own children saying they don’t feel safe and believe they could be harmed.” 

Abatti’s defense attorney, Owen Roth, pushed back, accusing law enforcement, not the county attorney’s office, of shaping a public narrative that has undermined Abatti’s presumption of innocence. They argued sensitive details of the case have been released in the media through press releases, a press conference, and the release of the autopsy report, creating what they described as an advocacy-driven portrayal of the facts.

Abatti’s attorney emphasized that his client self-surrendered within an hour of learning about the arrest warrant, waived extradition, and has no prior criminal history. He also highlighted Abatti’s deep ties to the El Centro community, where he is described as a legacy farmer, civic leader, and philanthropist.

The defense also underscored Abatti’s serious medical condition, telling the court he suffers from liver failure, requires frequent treatment at UC San Diego, and is on a transplant list. 

“This man is not going anywhere,” Roth said, arguing the existing bond was already extraordinarily high.

After reviewing sealed victim statements and hearing arguments from both sides, the judge increased bond to $5.5 million secured, citing safety concerns while also acknowledging the defendant’s medical needs.

“Frankly, the only reason I’m not increasing it super significantly is because I agree that it will be difficult for him to receive the health care that he needs, traveling back and forth from the jail here to doctors in California,” the judge said.

If Abatti posts bond, he will be subject to strict conditions: no contact with victims, including his children and a nephew who discovered the victim’s body; surrender of all firearms and travel documents; and limited travel only to California and Wyoming, with advance approval and detailed itineraries provided to prosecutors. He must also attend all of his court appearances in Arizona.

Abatti was advised of his rights, including his right to a jury trial, and defense attorneys formally waived speedy trial time due to what they described as multi-terabyte discovery involving digital forensic evidence.

A pretrial conference is scheduled for March 17, 2026, at 1 p.m. in Navajo County Superior Court.
